1. Acceptance of TermsBy using H&M Laundry LLC (“H&M Laundry,” “we,” “our,” or “us”) services, including drop-off, pickup, delivery, storage, or account-based ordering, you agree to comply with and be bound by this User Agreement. Use of our services constitutes acceptance of these terms.
2. Services Provided
H&M Laundry provides professional laundry services including wash–dry–fold services, drop-off laundry services, pickup and delivery services, linen and garment processing, specialty item processing, laundry storage services, and seasonal or second-home storage plans. All laundry is processed at 270 N. Main St., Suite D, Donnelly, ID 83615.
3. Customer Responsibilities
Customers agree to remove all items from pockets, inform us of stains or special care requirements, follow garment care label instructions, separate specialty items if special care is required, and ensure submitted items belong to the customer. H&M Laundry LLC is not responsible for items left in pockets, damage caused by improper garment labeling, manufacturer defects, normal wear and tear, color bleeding, shrinkage, or damage caused by previously weakened fabrics.
4. Pickup and Delivery Terms
Pickup and delivery services must be scheduled through our website, customer account, or phone request. Scheduled pickup and delivery times are estimated windows and are not guaranteed. Customers agree to provide safe access to pickup and delivery locations, secure pets, remove hazards, and place laundry in the designated pickup location. If laundry is not available at the scheduled time, service fees may still apply. Laundry is considered delivered when placed at the designated delivery location provided by the customer. Once delivered, responsibility transfers to the customer. H&M Laundry LLC is not responsible for theft after delivery, weather damage after delivery, or loss caused by unsecured delivery locations.
5. Weather and Environmental Delivery Disclaimer
Laundry delivered during adverse weather conditions is considered delivered once placed at the designated location. H&M Laundry LLC is not responsible for damage caused by rain, snow, ice, wind, freezing temperatures, or environmental exposure after delivery. Customers are responsible for retrieving delivered laundry promptly.
6. Turnaround Time
Standard turnaround time is approximately 48 hours. Turnaround times are estimates only and may vary due to demand, weather, staffing, or equipment issues. Turnaround times are not guaranteed. Rush services may be available for an additional fee.
7. Pricing and Payment Terms
Pricing is based on laundry weight, specialty items, pickup and delivery distance, and storage services if applicable. Customers agree to pay all applicable charges, maintain valid payment information, and authorize payment processing. Laundry subject to outstanding balances will not be released until payment is received in full.
8. Damage and Loss Policy
Laundry processing involves mechanical and chemical processes that may cause wear. H&M Laundry LLC liability is limited to the lesser of ten (10) times the service charge or one hundred dollars ($100) per order. Claims must be submitted within 48 hours of pickup or delivery and supported with item description. H&M Laundry LLC is not responsible for pre-existing damage, manufacturer defects, weak or worn fabrics, color fading, shrinkage, missing buttons, decorative damage, or normal wear and tear. H&M Laundry LLC is not responsible for damage caused by extended storage, mold, mildew, odor retention, pest exposure, fabric deterioration, or failure to retrieve laundry within designated timeframes.
9. Delicate and Specialty Items
Customers assume risk for delicate garments, hand-wash-only items, or items without care labels. Unless otherwise agreed, these items will be processed using standard laundering methods.
10. Unclaimed Laundry & Storage Policy
Customers receive fourteen (14) days of free storage beginning when laundry is completed. After fourteen (14) days, a storage fee of ten dollars ($10) per bag per month will be applied beginning on Day 15. Laundry will not be released until all storage fees and outstanding balances are paid in full. A bag is defined as one laundry bag, hamper, container, or bundled grouping reasonably equivalent to a standard laundry bag. H&M Laundry LLC reserves the right to determine bag count at its discretion.
Second Home Storage Plan: Twenty dollars ($20) per month per household includes storage of up to three (3) bags. Additional bags beyond three (3) are charged five dollars ($5) per bag per month. Participation requires an active account, valid payment method, and recurring billing authorization. Stored laundry remains at the customer’s risk. H&M Laundry LLC is not responsible for mold, mildew, odors, pest exposure, or fabric deterioration resulting from extended storage. H&M Laundry LLC may label, tag, photograph, or digitally record stored orders for inventory control. Laundry unclaimed after sixty (60) days is considered abandoned property and may be donated, disposed of, or sold to recover storage costs. Attempts to contact customers will be made using available contact information but are not guaranteed and do not extend the disposal timeline.
11. Customer Information & Privacy
H&M Laundry LLC respects customer privacy. We do not sell or share customer information with third parties except as required by law or necessary to process payments. Information collected may include name, address, phone number, email address, payment details, and order history. This information is used solely to provide services, process payments, communicate order status, and improve operations. Reasonable safeguards are maintained to protect customer information.
12. Communication Consent
Customers agree to receive SMS messages, email notifications, service alerts, and billing communications related to their account. Customers may opt out of marketing communications at any time.
13. Hazardous Materials Policy
Customers shall not submit oil-soaked items, chemical-contaminated items, biohazard materials, flammable materials, or any hazardous substances. Submission of hazardous items may result in immediate disposal, cleanup fees, service termination, and liability for damages.
14. Right to Refuse Service
H&M Laundry LLC reserves the right to refuse service for hazardous items, unsafe materials, excessively soiled items, or illegal materials.
15. Account Responsibility
Customers are responsible for maintaining accurate account information, protecting login credentials, and updating contact and payment information.
16. Indemnification
Customers agree to indemnify and hold harmless H&M Laundry LLC from claims resulting from improperly submitted items, hazardous materials, violations of this agreement, or misuse of services.
17. Force Majeure
H&M Laundry LLC shall not be responsible for delays or failure caused by weather conditions, natural disasters, power outages, equipment failure, labor shortages, transportation disruptions, or other events beyond reasonable control.
18. Limitation of Liability
H&M Laundry LLC shall not be liable for indirect damages, incidental damages, lost profits, business interruption, or consequential damages. Total liability shall not exceed limits defined in Section 8.
19. Governing Law
This agreement shall be governed by the laws of the State of Idaho. All disputes shall be resolved in Valley County, Idaho.
20. Modifications to Terms
H&M Laundry LLC reserves the right to modify these terms at any time. Updated terms will be posted on the company website. Continued use of services constitutes acceptance of updated terms.
21. Entire Agreement
This document represents the complete agreement between H&M Laundry LLC and the customer regarding services provided.
